Know All Men by these Presents, That We Samuel Wheelock, Amariah Wheelock and Obadiah Wheelock all of Tyringham in the County of Berkshire within the Commonwealth of Massachusetts, are holden and stand firmly bound and obliged unto Jahleel Woodbridge Judge of the Probate of Wills, and granting Administrations within the County of Berkshire, in the full sum of one thousand Pounds, in Lawful Money of the said Commonwealth, to be paid unto the said Jahleel or his successors in the said Office, or Assigns: To the true payment whereof, we bind ourselves, and each of us, our, and each of our Heirs, Executors, and Administrators, jointly and severally, for the Whole, and in the Whole, firmly by these Presents. Sealed with our Seals. Dated the fifth Day of March in the Year of our Lord, One Thousand Seven Hundred and Ninety-three.

The Condition of this Present Obligation is such, That if the above-bounden Samuel Wheelock to whom power of Administration on the Estate of Samuel Wheelock late of Tyringham decd is now granted do make, or cause to be made, a true and perfect Inventory of all and singular the Goods, Chattels, Rights and Credits of the said Deceased, which have or shall come to the Hands, Possession, of Knowledge of him the said Samuel or into the hands and Possession of any other Person or Persons, for him and the same so made, do exhibit, or cause to be exhibited into the Registry of the Court of Probate for the said County of Berkshire, at or before the first tuesday of June next ensuing; and the same Goods, Chattels, Rights and Credits, and all other the Goods, Chattels, Rights and Credits of the said deceased, come to the Hands at the time of his Death, which at any Time after shall and Possession of the said Samuel or into the Hands and Possession of any other Person or Persons for him do well and truly administer according to Law: And further do make, or cause to be made, a just and true account of his said Administration, upon oath, at or before the first tuesday of March which will be in the Year of our Lord One Thousand Seven Hundred and Ninety four. And all the Rest and Residue of the said Goods, Chattels, Rights and Credits, which shall be found remaining upon the said Administrator’s Account (the same being first examined and allowed of by the Judge or Judges, for the time being, of Probate of Wills and granting Administrations within the County of Berkshire, aforesaid) he shall deliver and pay unto such person or persons respectively, as the said Judge or Judges, by his or their decree or sentence, pursuant to law, shall limit and appoint: And if it shall appear that any last Will and Testament was made by the said Deceased, and the Executor or Executors therein named do exhibit the same into the Court of Probate for the said County of Berkshire, making request to have it allowed and approved accordingly; if the said Samuel Wheelock within bounden, being thereunto required, do render and deliver the said Letter of Administration (approbation of such Testament being first had and made) into the said Court: Then the before-written Obligation to be void and of none effect, or else to abide and remain in full force and virtue.

You are hereby appointed and empowered, on oath, to take an inventory of, and according to your best skill and judgment, truly and justly to apprize at the present value thereof, in lawful money of this Commonwealth, all the estate whereof Samuel Wheelock late of Tyringham deceased, died seized and possessed in said County; and you are to make return of this Warrant, with your doings therein, unto the probate office in the same County, as soon as conveniently may be---Said estate will be shewn you by Samuel Wheelock the Admr.

          Personally appeared Samuel Wheelock Admr. On the Estate of Samuel Wheelock late of Tyringham in said County, deceased, and made solemn oath that the annexed is a full and perfect inventory of all the Estate whereof the said Samuel died seized and possessed in the County of Berkshire, so far as has come to his knowledge, and that if any thing further should hereafter appear will render a further inventory or inventories thereof.

Warrant for Distribution of the Estate of Capt. Wheelock

Berkshire ss:

To Noah Allen, Adonijah Bidwell and Solomon Garfield all of Tyringham in the County of Berkshire within the Commonwealth of Massachusetts, and sufficient Freeholders,

Gentlemen Greeting.

Pursuant to the Power and Authority to me given, in and by the Laws of the said Commonwealth, I do hereby authorize and appoint You the above named three Persons a Committee to appraise all the Real Estate whereof Samuel Wheelock late of Tyringham in said County of Berkshire, deceased intestate, died seized and possessed (in said Commonwealth) in his own proper Right, in Fee Simple; each Piece and Parcel by itself, with their Names of Destination, Buts and Bounds, and Number of Acres, at the present true Value thereof in Lawful Money, all in Words at Length.

When you have perfected you Inventory, you are to set off to Hannah Wheelock (the said Deceased’s Widow) one full Third Part of the said Estate (so as may be convenient for her) for her Dower or Thirds, during her natural Life; and where you so set off, you are to describe by plain and lasting Metes and Bounds, that so Confusion may be prevented upon the Reversion of

The Remainder you are to distribute to and among the Children of the said Deceased, or so many of them as the same will conveniently accommodate, without Prejudice to or spoiling the Whole, Preference being had to the Sons.

Moreover, if any of the Children of the said Deceased have received any Thing of him in his Lifetime, in Advance towards their Portion, you are to signify the same to me, and how much each one has had.

When you go about you Works, let all Parties concerned have Notice; and if any Dispute arise about the Quantity of any Parcel of Lands, you may procure an Artist for the Survey thereof; and if all Parties are satisfied with your Proceedings, let them signify the same by countersigning.

Finally, seal up this Commission, with you Doings therein, and return the same with all convenient Speed, into the Registrar’s Office of Probate.

Given under my hand and Seal of Office, this Second Day of April Anno. Domini, One Thousand Seven Hundred and Ninety three and in the seventeenth Year of the Independence of the United States of America.

We the subscribed being Authorized & appointed by the Hon the Court of Probate for the County of Berkshire to Apprize & Distribute all the Real Estate whereof Samuel Whelock late of Tyringham in sd. County died seized & possessed of in his own proper Right, have apprized the same in the manner following viz. half of house Lot Number Sixty-two: to wit: forty four Acres and two thirds of an Acre on the East Side of said Lot, together with a Dwelling house standing on the same, Excepting the South west Room of said house which by Deed is the Property of Obadiah Whelock, also one half part of the Barn standing on the said premises. the other part of sd. Barn is the property of sd. Obadiah. said lands & building we have apprized at the Sum of one hundred fourteen pounds

Lot Twenty six rods and seventeen links to a stake & stones -- thence Southerly parrellel with sideline of said lot one hundred & Twenty eight rods to a stake & stones -- thence Easterly parrellel with the head line of said Lot Eight rods to a stake & stones – from thence to the first mentioned Bounds -- Containing by Estimation Twenty Eight Acres & two thirds of an Acre of Land. also the North Room of the Dwelling house the west Entryway & the priviledge of convenient part of the Sellar and one Quarter part of the Barn -- Said Lands & Building are valued by us at Sixty Eight pounds ten shillings

We have set no part of said deceased Estate to Ithamar Whelock son of said Deceased, it appearing to us that he has Received of his father in his life time in advance towards his portion his full share of said Estate.

We have set off to Levi Whelock son of said Deceased Ten Acres of Land being part of dec’d Lot Number Eighty Six Bounded west of the land set to Samuel Bounded as follows, beginning at stake and stones the southwest corner of Lands set to said Samuel, thence westerly on the head line of said Lot ten rods to a stake & stones, thence Northerly parrellel with division line of said Lot, to the North end of said lot, being one hundred & sixty rods, valued by us at six pounds -- which together with what he has Received of his father in his life time in advance makes the sum of Forty Six pounds, his full share of said Real Estate 46-0-0

We have set no part of said Real Estate to Amariah Whelock a son of said Deceased, it appearing to us that he has Received of his father in his life time in advance towards his portion of said Estate his full share of said Estate.

We have set no part of said Real Estate to Obadiah Whelock son of said Deceased, it appearing to us that he has Received of his father in his life time in advance towards his portion of said Estate his full share of said Estate.

We have set no part of said Real Estate to Mary Chenney Daughter of said Deceased, it appearing to us that she has Received of her father in his life time in advance toward her portion of said Estate her full share of said Estate.

We have set off to the Heirs of Hannah Jackson a Deceased Daughter of said Deceased the following Pieces of Lands, to wit, the Lot Number One hundred & sixty four, twenty acres valued at nine pounds, also Twenty Six Acres of land being part of Lot Number Eighty Six Bounded as follows -- Beginning at a stake & stones the southwest corner of Lands Set to Levi Whelock, thence westerly on the head line of said Lot twenty six rods, to a stake & stones, thence Northerly parrellel with the Division line of said Lot, to the North end of said Lot, being one hundred & sixty rods, valued by us at fifteen pounds Eight shillings & Eight pence, the aforesaid Pieces of Lands, together with what she Received in her life time of her father in his life time, in advance makes her full share of said Estate, being forty six pounds £46-0-0

We have set off to Rachel Whelock Daughter of said Deceased the following Lands to wit, part of Lot Number Eighty Six, Bounded as follows, beginning at a stake & stones, the southwest corner of Lands set to the heirs of Hannah Jackson Deceased -- thence Running westerly on the head line of said Lot, fifty one rods to a stake & stones -- thence Northerly a parrellel line with the Division line of said Lot one hundred & sixty rods to the North end of said lot -- thence Easterly on said North line to the lands aforesaid set to the heirs of said Hannah Jackson & contains fifty one Acres also the one half part of the East part of the Dwelling house consisting of a Kitchen, Bed room, and Buttarie, with one half of the uper Chambers & one half of the Cellers under said house: Excepting such Priviledges as are set to the widow of said Deceased in said Celler, also one Eighth part of the Barn -- the aforesaid lands & building so set to the said Rachel are valued by us at Forty six pounds & is her full share of said Real Estate £46-0-0

We have set off to Elizabeth Whelock Daughter of said Deceased the following Described lands Bounded as follows, beginning at a stake and stones the southwest corner of Lands set to Rachel Whelock -- thence westerly on said head line twenty one rods to a stake & stones being the South east corner of the widow’s thirds, thence Northerly on the east line of said thirds Thirty-two rods to a stake & stones -- being a corner of said thirds & from thence to continue on Northerly a parrellel line with the east line of said Lots to the North end thereof being in the whole one hundred & Sixty Rods -- thence easterly on the North line to the North west corner of Lands set to Rachel Whelock & contains twenty one Acres -- also the one half part of the east part of the Dwelling house consisting of a Kitchen, Bed Room, and Butterie, with one half of the uper Chambers & one half of the Celler under said house Excepting such priviledges as are set to the widow of said Deceased in said Celler -- also one Eighth part of the Barn the aforesaid Lands & building so set to the said Elizabeth are valued by us at thirty four pounds three shillings which together with what she Received of her father in his life time I advance makes the sum of forty six pounds & is her full share of said Real Estate.

We have set off to Isabel Carpenter Daughter of said Deceased the following Described Lands, to wit, Lot Number two hundred & thirty six containing sixty Acres -- also a part of house Lot Number Sixty Two Bounded as follows -- Beginning at stake & stones Thirty two rods Northerly of the South end of said Lot & ten rods westerly of the East line of said Lot, it being a Boundary of the widow’s thirds from thence Running westerly on the line of said thirds Eight rods to a stake & stones -- thence running Northerly on the east bounds of said thirds one hundred & twenty Eight rods to the North end of said Lot -- thence easterly on the North line of said Lot Eight rods to a stake & stones -- thence Southerly a parrellel line with the east line of said Lot one hundred and twenty Eight rods to the first mentioned Bounds and Contains Six Acres & Sixty four rods of Land, the aforesaid Lands are valued by us at Twenty five pounds Eight shillings --which sum together with what she has before Received of her father in his life time in advance makes the sum of Forty six pounds which is her full share of said Real Estate. £46-0-0

A Settlement of the personal Estate of Saml. Wheelock late of Tyringham in said County decd.

The amount of said personal Estate as appears by the Monetary thereof including rights and Credits is one hundred & seventy one pounds six shillings & five pence. £171-6-5.

The amount of debts due from said Estate including the amount of the Administration is fifty seven pounds five shillings & nine pence. £57-5-9.

It appears therefore that there remains of said personal Estate One hundred & fourteen pounds & eight pence which the Adminstrator is ordered to distribute & pay agreeable to the Law to wit: one third thereof to the Widow of said decd & the remainder to his Children in equal shares.

The above is ratified & confirmed.
